Mr. Dougherty is an intellectual property attorney whose practice is focused in the life-sciences industry. Chip has over 18 years of experience counseling clients such as pharmaceutical companies and research universities regarding patent strategy, technology licensing and litigation matters. He has represented clients in a wide range of litigation involving technology as diverse as pharmaceutical formulations (both branded and generic), DNA cloning and expression, medical devices, nutritional supplements, video streaming, financial services software, industrial hoist design, copyright ownership and horizontal drilling processes. Chip has worked for over 30 years in the fields of technology acquisition, product development, due diligence and IP litigation strategy by providing supporting analysis and opinions of counsel where appropriate. In addition to his work in the life sciences industry, Chip also works closely with clients to help develop trademark and branding strategies through registration, licensing and enforcement. Mr. Dougherty is also an experienced negotiator focused on resolving disputes through arbitration or mediation wherever possible. He has served as a client representative for ADR proceedings and is a court appointed mediator on the panel of neutrals for the Western District of Pennsylvania.

  • STROUT v. PHOTOGRAPHY SERVICES, LLC - U.S. District Court for the Western District of Pennsylvania, 2013 - Obtained withdrawal of copyright infringement complaint and dismissal of all claims through the ADR process.
  • SECALT SA v. WUXI SHENXI CONST. MACHINERY CO., 668 F.3d 677 - Court of Appeals, 9th Circuit 2012 - Affirming Federal District Court award of summary judgment of non-infringement and award of attorney's fees and costs in defense of trade dress infringement case.
  • 2011-12 - conducted IP due diligence on over 2 dozen early-stage life science companies on behalf of various private equity investors and investment funds.
  • ICC Arbitration 2009-10 - successfully represented large international pharmaceutical company in an arbitration involving a patent and technology license agreement directed to monoclonal antibody cancer treatments.
  • 2005-09 - led a team of attorneys and patent agents in analyzing the abuse-resistant opiate patent landscape for a development and clearance project.
